How to set reserved space for Section Header to zero

The following code (or something like it) seems to be reserving title space for the first Section (which has no title) which produces a suboptimal layout. What is standard practice to have this Section Header ignored for layout purposes? And as a folllow-on question why does the second Section (embedded in the List) not suffer a similar problem.
